Personal Injury Law Statute of Limitations:

Call Romeo Law and speak with personal injury attorney, April Romeo, about the statute of limitations that applies to your case.  The law gives you a limited period of time to resolve your personal injury case.   Tennessee law usually only gives personal injury victims one year to settle their case or file a lawsuit. This time frame includes and is not limited to car accidents, motorcycle accidents, truck accidents, slip and fall, premises liability, and other negligence claims.  There are a few exceptions, but not many.  Do not assume that your case is an exception. Do NOT trust the insurance company to give you the proper time table for when you need to settle your case or file a lawsuit.  Getting legal advice from a personal injury attorney is the best way to make sure that you are protected.

Personal Injury Victims Need to Protect Themselves. Get Legal Advice from a Personal Injury Attorney, Not an Insurance Agent or Adjuster:

Insurance companies are not looking after accident victims, they train their  adjusters to resolve claims as cheaply as possible. Insurance adjusters do not to look out for your best interest. Some insurance adjusters may seem friendly; do NOT mistake their friendly tone for intentions to get you compensated fairly.  Insurance companies make money by collecting premiums and paying as little as possible on claims; that is the adjusters’ goal.  If an insurance company can prevent paying personal injury victims’ medical bills, time missed from work, compensation for pain and suffering, or anything else, they will.

Most personal injury victims think their case is clear-cut and that most insurance companies will give them a fair settlement. Unfortunately, this is not always true. Unrepresented victims often make common mistakes that damage or decrease the value of their case.

Do NOT trust an insurance company to give you medical advice.  If you believe that you are injured, seek the advice from a doctor right away.

If your health insurance company pays for your medical expenses caused by a car accident, motorcycle accident, truck accident, or slip and fall accident, they may have a right to be reimbursed. This can be a delicate matter and if it’s not handled properly, it could jeopardize future benefits.

Keep in mind that any statement you give to the can be used against you.  If you are considering giving a statement to an insurance company, be sure to speak to an attorney first.

You do NOT have to sign a medical release prior making a claim.  The insurance company will need to evaluate records to process a claim, but you or your attorney can get those records. Please call our law firm before signing anything.
